I Can’t Go for That! #trademark #iplaw #music

Daryl Hall and John Oates

Each one a family man.

I love when my favorite passtime, music, intersects with the law. Okay, so this isn’t really about music, but it’s close enough to pique my interest. It looks like Hall & Oates is going one on one against a granola company. Hall & Oates (through their company, Whole Oats Enterprise) sued Brooklyn-based Early Bird Foods over use of the mark, Haulin’ Oats, for their latest granola product. The musicians already have a registered trademark for Haulin’ Oats and have licensed it to another vendor. While some have commented that the case is an easy case (eventually they’ll be able to say that they did it in a minute), Early Bird Food’s owner, Nekisia Davis, is apparently unconcerned. Perhaps he’s out of touch. In any event, his kiss is definitely not on their list.

Okay, I’ll stop.
